Error when no data in grid

I have a grid that is working pretty well, but when there no results returned I get a javascript error:

Line: 58269927
Error: 'find(...).0.rows' is null or not an object

Any Ideas?

The reported "No data in Grid throws error" is known issue in Grid and We have fixed this issue and will be available with our Syncfusion Essential Studio 2009 Volume 4.

Is there a workaround for this in the 2009 vol.3 version? While I understand that this is fixed in newer versions i am currently using version 3 and this bug makes it unworkable...
