XPMenus not disappearing when switching applications

I am having trouble with XPMenus.

Sometimes if I have a menu open and I switch to a different application the menu remains on top and doesn't disappear until I return to the my application. (see attached picture!)

However it is quite hard to reproduce, as it doesn't seem to happen every time. Here are a few observations about those times when it did happen...

o The menu contained a submenu which was also open.
o The windows Start Bar was used to switch to a different application
o The menu was a merged menu from an MDI child
o The application was running under XP (although I didn't try to reproduce it on any other version)
